Consumer Narrative

This Complaint is about Equifax In the month of XXXX of this year XXXX I disputed Multiple Fraudulent accounts that were reporting to all 3 bureaus. Equifax, XXXX XXXX XXXX. I sent multiple dispute Letters explaining the FCRA laws. I clearly stated in this Dispute Letter that this Debt is NOT owed by me and it is a Violation of the Fair Debt Collection Practices Act FDCPA -807 ( 15 USC 1962e ). On XX/XX/XXXX, I received an Alert from Equifax. They explained to me that all Fraudulent Accounts have been deleted off my file. My file was all clear and my score raised back into the mid XXXX where it originally was. I recently checked my Monitoring Service and Noticed on XX/XX/XXXX Equifax Reinserted an account that was previously Deleted. This account which is XXXX XXXX XXXX was one of the fraudulent accounts that I disputed and Equifax Deleted it off of my file. Now they have Reinserted this account reporting as Closed, {$30000.00} owed & Opened XX/XX/XXXX with a 76 month term with 97 % current payment made with one Not current payment in XX/XX/XXXX. This information is incorrect. The FCRA law states I was supposed to receive notification in writing within 5 business days about reinsertion of previously deleted accounts. Here is a snippet of the Dispute Letter I sent to Equifax about reinserting this account : In accordance with the requirements of the FCRA section 611 ( a ) ( 5 ) ( B ) ( ii ), you are required to notify me of the reinsertion in writing within 5 business days ( B ) Requirements relating to reinsertion of previously deleted material ( ii ) Notice to consumer If any information that has been deleted from a consumers file pursuant to subparagraph ( A ) is reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing no later than 5 business days after the reinsertion or, If authorized by the consumer for that purpose, by any other means available to the agency. I received no such notification. This is a very serious violation of the FCRA, and I reserve the right to pursue legal action for your blatant disregard for the Law.
