In addition to enforcing payment, the AG 's Child Support Division helps locate noncustodial parents, establish paternity, collect and distribute payments, and review and adjust child support orders. 15 U.S. Code 1681s1 - Information on overdue child support obligations Notwithstanding any other provision of this subchapter, a consumer reporting agency shall include in any consumer report furnished by the agency in accordance with section 1681b of this title, any information on the failure of the consumer to pay overdue support which ( 1 ) is provided ( A ) to the consumer reporting agency by a State or local child support enforcement agency ; or ( B ) to the consumer reporting agency and verified by any local, State, or Federal Government agency ; and ( 2 ) antedates the report by 7 years or less. As noted above in the referenced statute concerning Credit Reporting Agencies, the only permissable purposes of reporting child support payments/non-payments has to come by " A State or Local child support enforcement agency ". The State of Texas is the only child support enforcement agency that's legally authorized to report child support payments/non-payments. XXXX, XXXX, & Experian are violating the FCRA by reporting child support payment history via-third party agency. The State of Texas does not have an account with E-Oscar that allows their computers to communicate with each other. The following account is in violation of the FCRA : 1. OAG Child Support Enforcement opened XX/XX/2016 15 U.S. Code 1681e - Compliance procedures ( b ) Accuracy of report Whenever a consumer reporting agency prepares a consumer report it shall follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates.
