CONFIDENTIAL Dear Consumer Finance Protection Bureau : My name is XXXX XXXX. I am an XXXX duly licensed to practicXXXX XXXX XXXX XXXX ( MN XXXX. Lic. No. XXXX ) I am representing XXXX XXXX ( XXXX XXXX XXXX ) with respect to her loan with Truist Bank. My client was approached by a HVAC contractor who offered to make a loan to my client to complete some needed work and improvements at her home. My client is XXXX and XXXX, so this was of interest to her although details were not discussed. Of particular concern to her were the amount of any payments. The HVAC contractor completed the work and said everything with the financing was complete, which confused my client a bit. Apparently, the HVAC had some connection or arrangement to sell my client 's debt obligation to Truist Bank. There have been endless problems ever since. The documents attached to this CFPB complaint I am filing on behalf of XXXX XXXX ( XXXX XXXX XXXX ) provide extensive details about what I have requested to Truist Bank of investigate and resolve these matters on behalf of my client. Truist Bank has failed to comply with my requests. Once Truist Bank investigated these matters and replied to my requests, the intent was to try entering into some type of settlement arrangement with Truist Bank satisfactory to my client. This does not appear likely at this point. In addition to the facts described in the attached documents, it is my opinion as an experienced bank attorney that Truist Bank is likely to have committed violations of federal and state law including but not limited to the following : -- Unfair or Deceptive Acts or Practices ( UDAP ) -- Unfair, Deceptive, or Abusive Acts or Practices ( UDAAP ) -- Fair Debt Collection Practices ( FDCPA ) -- Fair Credit Reporting ( FCRA ) The attached documents and the above-referenced factual outline should be sufficient to commence this complaint.
