On XX/XX/2019, Carmax repossessed my car and said that I had to pay to get my car back. This is not where the fraud ends! Pursuant, 15 U.S. Code 1605, finance charges are explained. Built into the finance charge is an insurance that protects the lender in the event the obligor defaults. Carmax sold my car in auction. I defaulted on XX/XX/2019. Which means Carmax received insurance money! They took it even further and put it on my consumer report stating it as a charge-off. Well, according to the IRS, when a creditor cancels a debt or file a form XXXX on any amount over {$600.00}, they must send the obligor/consumer a form XXXX. {$13000.00} was written off. I never received my form XXXX for this cancelled debt! A cancelled debt means exactly what it says, a cancelled debt! So, how did they coerce me into paying the balance? They have deceived me, and they have frauded me! In addition to the insurance money they collected, the IRS classifies a charge-off or cancelled debt as gross or income! You are reporting a charge-off on my consumer report. Income does not get reported on my consumer report! This is inaccurately reporting this account! Furthermore, Carmax has committed tax fraud! They have this account reporting on my consumer report as a cancelled debt, meaning that portion of the debt has been cancelled.
