On XX/XX/2022, I reached out to the loss recovery department of XXXX XXXX in regard to negative information being reported to the credit reporting agencies. XXXX XXXX has been reporting my account as charged off from XXXX XXXX XX/XX/2022. The XXXX XXXX representative from the loss recovery department stated that according to their policy there is a difference between a write off and a charge off, however according to 7 CFR 1956.54 A charge off is defined as the writing off of a debt and termination of collection activity without release of personal liability. I wanted clarity on if their policy definition supersedes the federal laws definition and I was transferred to many representatives who couldn't assist me at all. XXXX XXXX is furnishing my nonpublic personal information to third parties ( Credit reporting agencies ) without my consent ( 15 USC 1681s2 ). The reporting of this negative information is ruining my financial reputation, and this is unlawful activity that is causing me substantial harm. The representative stated that per their policy they are required to report the information and that is a violation of 18 US Code 892 which is them stating that they knew I was going into an extortion and extension of credit.
