Consumer Narrative

On XX/XX/XXXX, my sister in XXXX, AL called me to ask if I would be willing to co-sign a loan with her so that she could get new windows and siding for her home ( work to be completed by XXXX XXXX XXXX ). I spoke with a sales rep, XXXX, by phone, who asked if he could run a credit check on me to see if I was eligible to co-sign with my sister. I gave him verbal permission to do the credit check. My credit was okay, so I agreed to co-sign a loan for {$21000.00}. I told my sister she could sign my name as CO-BORROWER. It is my understanding that XXXX and my sister discussed an arrangement in which she would be the first line of contact for billing statements related to loan servicing. In XX/XX/XXXX, I began getting repeated calls from GREENSKY, which I later found out was the loan servicer, not XXXX XXXX XXXXXXXX. On XX/XX/XXXX, XXXX informed me that the loan payment was 13 days past due. I assumed they had also contacted my sister since we were to be co-borrowers, but they said that I was listed as the SOLE borrower on the loan, so they could not talk to my sister. At no time during the XX/XX/XXXX phone call with the sales rep, XXXX, had I been informed that I would be the SOLE BORROWER on the loan. In early XXXX, I called XXXX XXXX XXXX and spoke with XXXX. I explained the situation to XXXX. She said she would have XXXX call me back. After several hours, XXXX had not returned my call, but he contacted my sister. My sister sent me a text which said XXXX had called her to say that I had given permission to be listed as the SOLE borrower on the loan. Im not sure why he called my sister instead of me, since the loan had been put in my name, and I was the one who called him. Immediately afterwards, I again called XXXX XXXX XXXX and spoke with XXXX. This time XXXX called me back. I asked him to explain how the loan ended up with me listed as the SOLE borrower on the loan. He said I gave permission. I did not give permission to be listed as the SOLE borrower on my sisters loan. I agreed to co-sign with her on the loan, but I would not have taken the responsibility of being SOLE borrower if I had known that Greensky did not want my sister listed as a co-borrower. This information was not clearly communicated, if at all. As a result, I did not have the opportunity to make an informed decision about whether or not I wanted to be a participant in the loan agreement. It makes sense to me that if I had agreed to be SOLE borrower, then all loan paperwork would have come to me for signatures. After the XX/XX/XXXX loan date, I did not get any paperwork, sign any paperwork, or get copies of any paperwork showing me as SOLE borrower. I had to request the paperwork completed on XX/XX/XXXX from XXXX XXXX XXXX. XXXX was emailed to me in XX/XX/XXXX. I had not been informed that Greensky would be the loan servicer. I only found that out later after repeated calls for XXXX collection. I submitted written complaint letters concerning this matter to Window World XXXX on XX/XX/XXXX and to the Alabama Attorney Generals office in XX/XX/XXXX. Neither entity helped me to resolve the matter.
