Consumer Narrative
On XX/XX/2022 I received an alert notifying me that a new collection had been reported on my credit bureaus. I checked and saw that a company called XXXX XXXX XXXX was showing a debt owed. This was a surprise to me because I had not received any type of communication from this company and according to the CFPB Debt Collection Rule : Before a debt collector can report your debt to a credit reporting company, the debt collector must do any one of the following : Speak with you in person about the debt, Speak with you by telephone about the debt, Mail you a letter about the debt and wait a reasonable amount of time ( generally 14 days ) for a notice that the letter wasnt delivered, or Send you an electronic communication about the debt and wait a reasonable amount of time ( generally 14 days ) for a notice that the message wasnt delivered. None of this was followed .... To this date I still show this reporting to the credit bureaus without my written instructions. I have never done any business with this company have any type of contract or agreement, and therefore they have no right to report anything on my credit report. XXXX XXXX XXXX is also reporting this an open account with them as XX/XX/2022 which is fraud. In accordance with the Fair Credit Reporting Act - XXXX XXXX XXXX - Account # XXXX has violated my rights. 15 U.S.C 1681 Section 602 A - States I have to the right to privacy 15 U.S.C 1681 Section 604 A - Also states that a consumer reporting agency can not furnish an account without my written instructions.
