Consumer Narrative
This complaint is regarding an account on my credit report from XXXX XXXX XXXX of {$10000.00}. Under Section 611 ( 5 ) ( A ) of FCRA any account and all information pertaining to it should be promptly deleted if it can not be verified. I have sent 4 letters to Equifax starting XXXX of XXXX asking to see verifiable proof ( hard evidence going all the way back to the original creditor, not verification from third-party database ) regarding this account. ( my first letter was on XX/XX/XXXX ) Under the FCRA, unverified accounts must be removed if Equifax is unable to provide a copy of verifiable proof. Their response was that the account is mine, without any hard evidence going all the way back to the ORIGINAL creditor and without verifiable proof. On XX/XX/XXXX I sent my second written request to them asking for a description of the procedures used to determine the accuracy of this account. But they did not provide me with any hard copy documentation showing that they properly verified this account and although under Section 611 ( 5 ) ( A ) ( i ) of the FCRA they are required to " promptly delete all information which can not be verified '', they did not delete the account and I receive the same response- verified- without any documentation as asked. On XX/XX/XXXX of XXXX I sent my third written request to Equifax, asking them again to delete this account because they did not provide copy of any documentation ( hard evidence that goes all the way back to the original creditor, not verification from a third-party database ). Also, they did not provide the method of verification as required under section 611 ( a ) ( 7 ). Again section 611 ( 5 ) ( A ) of the FCRA states that any information which can not be verified with proper documentation to be promptly deleted. On XX/XX/XXXX I sent my 4th written letter to Equifax because the account is still on my credit report unverified. Again i did not receive copy of any original documentation for this account and no method of verification was provided. The account is still on my credit report. All my letters have been sent certified mail with return receipt and signature on them. Also all letters were signed by a notary agent before sending them.
