Consumer Narrative

ATTN : XXXX XXXX XXXX RE : XXXX On XXXX/XXXX/2022, I wrote to you and requested information about an account you are reporting on my credit report but you never responded. I then sent another letter to you on XX/XX/2022 and XX/XX/2022 advising that if you failed to respond and/or comply with the law, then you would be subject to fines and damages, per the FCRA. You still failed to comply. Please note, for the record, that this is my final attempt to reach a resolution directly through your company to resolve this issue. I am no longer merely requesting verification of this alleged debt. At this point, I am formally demanding that within the next 7 days, you remove this unverifiable account from any and all credit bureau reports in which you are reporting to and that you send me notification of your intent to do so. Should I not hear from you, again, within the next 7 days, and you are still reporting this account at that time, then the next communication you receive from me will include copies of formal complaints made to the XXXX XXXX XXXX, the State Attorney General, and the Federal Trade Commission not to mention my legal counsel and the local media that I plan to reach out to in order to expose your unlawful business practices. I would much rather resolve this issue both swiftly and amicably without the involvement of anyone else. Therefore, your response by XXXX/XXXX/2022 would be greatly appreciated! I am disputing the account stated above. Previously, I disputed this account information as being inaccurate, and you never responded, but updated on website that " This item was updated from our processing of your dispute in XXXX 2022 '' and that my last complaint was a duplicate. My last complaint was a notice of estoplle by your silent Under the laws of the FDCPA, I have contacted the collection agency Denefits llc myself, and they have failed to verify that this is indeed my debt. I enclosed copies of my requests to the collection agency, asking them to validate the debt, as well as the receipts showing I sent this letter by certified signature request. I was given no evidence of my obligation to pay this debt to this collection agency. The Fair Credit Reporting act requires you to verify the validity of this within 30 days. If the validity can not be verified, you are obligated by law to remove it from my credit file. I urge you to remove this account before I am forced to take legal action. In the event that you can not verify the item pursuant to FCRA, and you continue to report it on my credit, I will find it necessary to sue you for actual damages and declaratory relief. According to FCRA regulations, I may sue you in any qualified state or federal court, including small claims court in my area. I look forward to a swift and amicable resolution to this matter. Thank you for your time.
