Over a decade ago I had a credit card account with Capital One that went into default. Approximately 3 or 4 years ago this account stopped being reported on my credit report since it was older than 7 years. Today, several years after the account had fallen off my credit report, I was declined for a XXXX XXXX XXXX. The reason listed was only " too many delinquent past or present Capital One credit obligations. '' If there is a 7 year limit on derogatory credit information, and my previous account is about 11 years old and no longer shows up on my credit report for several years, how is this information still being used against me? I believe that Capital One is illegally maintaining and using derogatory information for accounts beyond the 7 year limit. This seems like a violation of my privacy, and I have worked hard to ensure my credit is sufficiently re-established from a negative life event over 10 years ago. Is capital one routinely maintaining zombie debt records that will haunt me for the rest of my life? Is there any way to force capital one to purge this information just like it fell off my credit reports a few years ago? The weirdest part of this whole scenario is that I've had 2 Capital One Auto Finance loans with great terms fully paid ( with no late payments ) in the past 5 years. This is likely a problem specific to the credit card department.
