Consumer Narrative
I attempted to verify an incorrect debt on my credit report. On XX/XX/22, I sent a debt validation letter by mail to Capio Partners located at XXXX XXXX XXXX XXXX XXXX, XXXX, Texas XXXX. On XX/XX/22, this company sent me a response stating that they did not have sufficient time to complete their investigation. Then, on XX/XX/22, I received another letter stating that the original creditor sold this debt to XXXX XXXX XXXX, and then XXXX XXXX sold this debt to Capio Partners. Also, enclosed was a " statement of account ''. This statement was NOT a letter from the original medical provider. There is also very specific and personal diagnosis and treatment information included on this " statement of account ''. According to the Department of Health and Human Services, if debt to a medical facility goes unpaid, the facility has the right to take measures to collect the debt, including selling your personal information to a medical debt collector. The information that can be provided to the collector is limited to your name, address, social security number, birthday, payment history, and location and name of the facility you were treated in. While this seems like a lot of information, the medical facility CAN NOT disclose the nature of your treatment to the collector. By including these details, the medical collection ARE IN DIRECT VIOLATION OF HIPAA REGULATIONS and can face fines. I would like this debt to be removed immediately from all credit reporting agencies or I will have no choice but to seek legal action.
