I, the consumer, reached out for the second time to Comenity Capital Bank regarding a late fee of {$35.00} added to my consumer credit account ( see exhibits attached ). I mailed them a billing error letter, dated XX/XX/2022, letting them know that they are in direct violation of 15 U.S. Code 1666b and they need to remove the late payment from my consumer credit card account. ( see exhibit attached ). Comenity Capital Bank responded to my complaint stating they are unwilling to remove the late fee due to the terms explained in the credit card agreement. They also stated in their claim that they are required by law to report factual information to the credit reporting agencies. Comenity Capital Bank is in violation of 15 U.S. Code 1666d 15 U.S Code 1692j - Furnishing certain deceptive forms 15 U.S. Code 6821 ( a ) ( 2 ) - by making a false, fictitious, or fraudulent statement or representation to a customer of a financial institution ; 15 U.S Code 6823 ( a ) - In General, Whoever knowingly and intentionally violated, or knowingly and intentionally attempts to violate, section 6821 of this title shall be fined in accordance with title 18 or imprisoned for not more than 5 years, or both.
