I got a call from a representative from Genesis Card Services on today. Monday, XX/XX/2022, and I am continually getting representatives that are breathing on the voicemail or saying my name continually and then hanging up the phone. I recently received a call on XXXX, XX/XX/2022, at XXXX and the representative did not leave a voicemail. I feel these tactics are Genesis being able to say that an attempt was made to contact me. I found out it was Genesis Card Services after looking up on XXXX and reading the reviews. I dialed the phone number as well and an automated prompt came up for Genesis Card Services. The phone number used is XXXX. Genesis FS Card Services and is a subsidiary of XXXX XXXX XXXX XXXX XXXX. https : XXXX There must be a representation, OMISSION, or practice that misleads or is likely to mislead the consumer. An act or practice may be found to be deceptive if there is a representation, omission, or practice that misleads or is likely to mislead a consumer. Deception is not limited to situations in which a consumer has already been misled. Instead, an act or practice may be found to be deceptive if it is likely to mislead consumers ... Omission of information may be deceptive if disclosure of the omitted information is necessary to prevent a consumer from being misled. An individual statement, representation, or omission is not evaluated in isolation to determine if it is misleading, but rather in the context of the entire advertisement, transaction, or course of dealing. I find this to be a deceptive act by Genesis FS Card Services because I am unable to know my account standing as of now. Secondly, the representatives have not left a call back number for any debt resolution. The omission of this information has caused me to be unable to decipher or determine what is my best decision after as debt resolution with their company. Lastly, I have not been informed of any changes to my credit reporting or any risks I have with the current standing of the account in compliance with : 609. Disclosures to consumers [ 15 U.S.C. 1681g ] ( a ) Information on file ; sources ; report recipients. Every consumer reporting agency shall, upon request, and subject to 610 ( a ) ( 1 ) [ 1681h ], clearly and accurately disclose to the consumer : ( 1 ) All information in the consumers file at the time of the request except that ( A ) if the consumer to whom the file relates requests that the first 5 digits of the social security number ( or similar identification number ) of the consumer not be included in the disclosure and the consumer reporting agency has received appropriate proof of the identity of the requester, the consumer reporting agency shall so truncate such number in such disclosure; and ( B ) nothing in this paragraph shall be construed to require a consumer reporting agency to disclose to a consumer any information concerning credit scores or any other risk scores or predictors relating to the consumer.
