Consumer Narrative

I filed a complaint with u guys about the improper reporting of information on my credit report by u guys and received a response basically ignoring my most important complaints and saying basically its not ur fault. My complaint was not a matter of my account being mine or not. I never once said I'm disputing this account being mine. It's about all the misinformation in my account so you clearly didn't read my complaint. I asked for u to investigate every piece of info on my account and send a pdf with all the improper info.. Now I'm glad to hear that you've apparently investigated the info you've submitted to the credit bureaus and verified it as correct so I can have more proof of complete disregard to the proper reporting of my report to the bureaus. Please review the attached document that I send with my previous complaint with all the highlighted mis matched information on all bureaus which when I call they say its furnished by you guys and that only u guys can change it. You're literary reporting wrong information XXXX cant believe you even said you updated my account as " 180 days past due '' when it's in collections! An account in collections CAN NOT! be past due! You claimed that I haven't made a payment since XX/XX/XXXX. Which is also wrong according to the information you've reported. I haven't made a payment since XX/XX/XXXX according to my report. You don't even have the proper information! What kind of investigation did u conduct? And since my last payment on XX/XX/XXXX, you reported my account late for 15 months till it was finally charged off, closed, and send to collections in XX/XX/XXXX and was being reported as in collection since XX/XX/XXXX to XX/XX/XXXX. Thank you for giving me more proof that you don't even have your information correct and if XX/XX/XXXX is the day I made my last payment which I know for a fact it isn't then you've just given me more proof that you're furnishing wrong information on my report. Either way, you're in violation. How did you do a proper investigation when none of the info on all credit bureaus match? IF u guys did not furnish this improper information, then I need a copy of what the proper information is with proof. you were supposed to investigate all the mis match information reported to all the credit bureaus. The misreported information is Late payment, Payment Status, Worst payment status, account status, times XX/XX/XXXX late, date of last payment, late payments. How did you come to the conclusion that the info on my report is accurate when this information isn't the same on all bureaus? You're the only collection on my report which is not reporting the same info on all three bureaus so dont blame the agencies. I'll list all the violations you guys have made against my account and please explain to me how you haven't done any of them word by word instead of saying your investigation revealed it not to be true. First violation, you went from reporting an account as in collections for three Years since it got put in collections, which Is what you're supposed to do, to then suddenly reporting this account as late payments for 24 months which caused significant financial damage to me and under the FCRA for this improper act I am owed {$1000.00} per violation which is every single month you've reported an account in collection as past due instead totaling {$24000.00} for each month in the 24 months you've misreported it. The only time an account should be reported as past due or late payment, is when an account is open. You are blatantly violating the FCRA. How can you go from reporting my account as in collections to etc days past due? I need a thorough explanation as to why you did that. Which brings me to the second violation, you're reporting this account as open when it is charged off and in collections. Another violation, Under FCRA its a violation for creditors to supply information to a CRA that it knows or ( should know ) is inaccurate. I send a pdf with all the highlighted mis matched information in my last complaint, instead of calling the credit bureaus and fixing these errors, you blatantly ignored it and just informed me that it is not your fault if the bureaus are reporting wrong information when it is your fault as you are the ones furnishing this info to the bureaus but regardless of that, you acknowledged the errors, and failed to act on it by sending proper info to all bureaus and let my report have mis match information which is an extreme violation of my rights under the FCRA and of your duties as a CRA. Word for word in the FCRA. " If, after any reinvestigation under paragraph ( XXXX ) of any information disputed by a consumer, an item of the information is found to be inaccurate or incomplete or can not be verified, the consumer reporting agency shall - promptly delete that item of information from the file of the consumer, modify that item of information, as appropriate, based on the results of the reinvestigation and promptly notify the furnisher of that information that the information has been modified or deleted from the file of the consumer '' You did not even attempted to update the information on my file with the bureaus in which you report you and I send documentation highlighting every mis match information. I'd love to see how you're going to explain that. I asked for a reinvestigation of every piece of info and stated what's incorrect and you did absolutely nothing about it but blame the bureaus when its your job to report the proper info to them and ensure there no improper info on my report because that makes u liable for violating laws under the FCRA of ur duties as furnishers of reports to cra. The fourth violation, under the FCRA, after a consumer files a dispute, you're supposed to stop reporting all information thats been reported as inaccurate by the consumer till the end of your investigation. Which you did not. Again, I send a highlighted document with all the wrong information and you were still allowing the bureaus to report it. Under section 611, I have the right to dispute information I believe to be incorrect or unverifiable and if the disputed information can not be verified or confirmed then it must be removed. As per your response to my complaint, you acknowledged the reporting of inaccurate information and said you can't control what the bureaus report which you can as its your job to do so and if the info is incorrect, its your job to tell them that. A proper investigation by definition under the FCRA was CLEARLY not done and anyone with a brain and eyes and under the court of law would see that if they saw all the misreporting on my credit report. Now since the violations I stated are wrong, please explain to me with verifiable proof how I am wrong and you are right or remove this account immediately and I am requesting financial compensation for every single violation. I will also be filing a report with XXXX, XXXX and XXXX to ask them for verifiable proof of the information you've submitted to them since it's apprently their fault according to you that their is mismatched information which you cared less about contacting them to fix.
