Consumer Narrative
To whom it may concern : I've been trying to fix my credit report since last year after I received a copy of my credit report with the intention of trying to improve my credit to purchase a home and new vehicle. I noticed a few accounts that I wanted an investigation done properly. Im certain that The Fair Credit Reporting Act states that my credit report should be 100 % accurate. Ive listed accounts below thats not 100 % accurate. Ive highlighted the violations below on each account. These accounts have discrepancies for Date opened, date last active, close date, date of last payment, last reported, high credit limit, to monthly payments being reported falsely to not being reported on all three Credit Bureaus. This is grounds for removal and monetary compensation for violating my rights under 15 U.S.C 1684 section 602 A. Stated I have the right to privacy. 15 U.S.C 1681 SECTION 604 a section 2 : It also states a consumer reporting agency can not furnish an account without my written instructions. I want proof of Validation of the debt -- that is, the actual accounting and verification of a signed invoice with a copy of the Contract binding both parties ( me and them ), in a letter by " certified mail '' so that there is an independent " witness to it having been delivered. '' However, according to 15 USC 1692E,15 USC 1692D, AND 15 USC 1692B not use any language or symbol on any envelope or in the contents of any communication affected by mails or telegram that indicates that the debt collector is in the debt collection business or that the communication relates to the collection of a debt. Under U.S.C. 1681n Civil liability for willful noncompliance ; 1681n ( a ) In general Any person who willfully fails to comply with any requirement imposed under this subchapter with respect to any consumer is liable to that consumer in an amount equal to the sum of ( 1 ) ( A ) any actual damages sustained by the consumer as a result of the failure or damages of not less than {$100.00} and not more than {$1000.00} ; or ( B ) in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure or {$1000.00}, whichever is greater. They continue to give the same generic response of doing an investigation without sending any proof of said investigation method other than sending me a credit report with everything verified as accurate. Which is a blatant lie on their parts. I've put a freeze on the so-called data furnishers and disputed the inaccurate information they have also. They've lied to you and the CFPB continuously without any repercussions. I demand to be monetary compensated for the pain and suffering. They're also in violation of 15 U.S.C. 1681i ( a ) Reinvestigations of disputed information ( 2 ) Prompt notice of dispute to furnisher of information ( A ) In general Before the expiration of the 5-business-day period beginning on the date on which a consumer reporting agency receives notice of a dispute from any consumer or a reseller in accordance with paragraph ( 1 ), the agency shall provide notification of the dispute to any person who provided any item of information in dispute, at the address and in the manner established with the person. The notice shall include all relevant information regarding the dispute that the agency has received from the consumer or reseller. ( B ) Provision of other information The consumer reporting agency shall promptly provide to the person who provided the information in dispute all relevant information regarding the dispute that is received by the agency from the consumer or the reseller after the period referred to in subparagraph ( A ) and before the end of the period referred to in paragraph ( 1 ) ( A ). Which they've failed to do on multiple occasions. ( 5 ) Treatment of inaccurate or unverifiable information ( A ) In general, after any re-investigation under paragraph ( 1 ) of any information disputed by a consumer, an item of the information is found to be inaccurate or incomplete or can not be verified, the consumer reporting agency shall ( i ) promptly delete that item of information from the file of the consumer, or modify that item of information, as appropriate, based on the results of the re-investigation; and ( ii ) promptly notify the furnisher of that information that the information has been modified or deleted from the file of the consumer.
