I am writing this notice in reference to the initial dispute I filed about unauthorized items on my consumer credit report being identity theft. As a reminder, all consumer reporting agencies have to comply with the Fair Credit Reporting Act ( FCRA ) in its entirety. You are also required to provide fair, accurate & equitable reporting with respect for the consumers right to privacy. To reiterate, I am a victim of identity theft. I submitted the initial dispute with the following documents : Federal Trade Commission report, identity theft affidavit ( notarized ), proof of identity and a bill of particulars. In accordance with 15 USC 1681c-2, these items were supposed to be removed within four ( 4 ) days of receipt of notice. However, your company did not remove these fraudulent items from my consumer credit report which is causing me to experience adverse action when trying to acquire shelter, transportation and credit. To be clear, this dispute was NOT made in error, this dispute is NOT based on material misrepresentation of facts, and I did not obtain possession of goods or services as a result of any blocked transaction. This is NOT a frivolous claim, as I am the protected consumer initiating this dispute. These items are causing defamation to my character and harm to my mode of living. I made it clear that these unauthorized items are a result of identity theft. You have not provided me with your method of validating these items or any documentary evidence to prove these items belong to me as I requested over 30 days ago. E-Oscar is NOT a proper means of investigation. Your company will be held liable under the willful non-compliance section of the FCRA ( 15 USC 1681n ) if you do not remove these items indefinitely from my report. You will also be liable for any adverse action I experienced due to the furnishing of these inaccurate items. The evidence of adverse action has been attached to this notice. XXXX conducted a proper investigation and removed these items from my consumer credit report in their system in accordance with the FRCA. You are required to do the same. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. Please correct this error and remove these items in good faith or I will proceed with legal matters. All information has been forwarded to the State Attorney General, the XXXX XXXX XXXX the Consumer Financial Protection Bureau, the Federal Trade Commission, and the registered agent, CEO and CFO of your company. Please notify me in writing of a settlement offer to resolve this error as well as written notification that the items have been deleted within four ( 4 ) days of receiving this notice to avoid any further violations. Thank you in advance for your cooperation.
