On XX/XX/XXXX, I received a personal loan from Omni Financial of Nevada , Inc. in the amount of {$700.00}. The terms of my loan were that I would pay {$110.00} a month for 7 months by either : allotment through the XXXX XXXX and XXXX XXXX ( XXXX ) or set up Electronic Fund Transfer ( EFT ) through my personal checking account at XXXX. Ultimately, my repayment method was by allotment through XXXX. Omni violated the Military Lending Acts prohibition on requiring repayment of the loan by allotment and the Electronic Fund Transfer Acts ( EFTA ) prohibition against requiring that consumers preauthorize electronic fund transfers as a condition of receiving credit. Omni also violated the consent order that requires Omni to provide notice of the Consumer Financial Protection Bureaus XX/XX/XXXX findings to all customers repaying their loans by allotment. That notice was never extended to me and I wouldnt have known to ask for it. Along with the violations, my first repayment was not to be made until XX/XX/XXXX and my final repayment to be made XX/XX/XXXX. Omni took my first repayment by allotment on XX/XX/XXXX, and two additional payments after my loan was fully repaid by allotment on XX/XX/XXXX and XX/XX/XXXX. I am able to see the XXXX allotment due to my XXXX online account which shows my mid month and end of month pay plus any allotments 7 days before my end of month paycheck. I decided to check that today ( XX/XX/XXXX ) due to the unauthorized allotment on XX/XX/XXXX. The XXXX payment was refunded XX/XX/XXXX in the full amount of {$110.00}. The XXXX payment was refunded XX/XX/XXXX in a partial amount of {$100.00}, I was not made aware of the fact they owed me anything until XX/XX/XXXX, 7 days after the allotment was sent to them. I am unable to get the XXXX payment refunded until after the XXXX as their systems wont receive it until then despite my Leave and Earnings statement showing the future transfer. Omni did not terminate the allotment on their end and never contacted me via phone, e-mail, or my Omni dashboard once the loan was fully repaid to notify me that I needed to terminate the allotment through DFAS if they were unable to do so.
