XXXX XXXX XXXXXXXX XXXX XXXX VW Credit Inc. violated the Truth in Lending Act on XX/XX/XXXX with dealer number XXXX contract XXXX, XXXX # XXXX pursuant 15 USC 1605 ( a ) when it required me to make a {$5000.00} down payment on my XXXX VW XXXX. Furthermore, XXXX XXXX XXXXXXXX / VW Credit Inc. was in violation of 15 USC 1605 ( e ) ( 2 ), when it included a {$690.00} documentation fee in the {$27000.00} that it financed in the sale of the Passat. In XXXX, VW Credit Inc. repossessed and auctioned the XXXX VW XXXX then charged off the remaining debt which it claims to be {$6600.00} and reported it to all three major credit reporting agencies. As defined by the IRS, a charge-off is considered gross or ordinary income. Income, consequently, does not get reported on a consumer report. Furthermore, VW Credit Inc. sold the {$6600.00} debt and shared my information with a third party without my permission, a direct violation of the FDCPA. Pursuant 15 USC 1692 ( b ) Communication with third parties Except as provided in section 1692b of this title, without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a postjudgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than the consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector. VW Credit Inc. is also in violation pursuant 15 USC 1692 ( 608 ) ( 4 ) - The advertisement for sale of any debt to coerce payment of the debt. I contacted VW Credit Inc. and was told that VW Credit Inc. no longer has my records and that a collection company has my information and is now attempting to collect on the charged-off {$6600.00} debt. I recently received notice from collection company XXXX XXXX XXXX XXXX of New Jersey. XXXX XXXX on its mail correspondence that, this is an attempt to collect a debt. I note that this alleged debt, allegedly connected with VW Credit Inc., is disputed and validation requested.
