My name is XXXX XXXX and I am WRITTING you about an entry listed on my credit report which I have tried to have removed. Apparently someone with a similar name to mine filed bankruptcy in ( NAME OF COURT AND DISTRICT HERE, and it is appearing on my credit report. After contacting the Bankruptcy Court, they informed me that they do not provide anyone with a debtors full social security number, and they do not provide any credit bureau any information relating to any bankruptcy cases. As you well know it is a violation of the Fair Credit Reporting Act to report erroneous information on a credit report. I ask that you remove it immediately. VICTIM OF IDENTITY THEFT! Please be advised this is my SECOND WRITTEN REQUEST. You failed to block the fraudulent accounts and inquiries I requested in my last correspondence to you sent via Certified Mail, and by doing so you have incurred civil liability for Willful Non-Compliance under Section 616 of the FCRA. I keep all records of my correspondence with you so I am prepared in case I need to take you to court. I am a victim of identity theft, which has resulted in negative and false information being placed on my credit report. According to the Fair Credit Reporting Act Section 605 ( b ), you are required by Federal Law to delete ALL accounts and inquiries resulting from Identity Theft within a maximum of 4 Business Days from the receipt of a Police Report and/or Fraud Affidavit. THIS IS A REQUIREMENT, AND NOT AN OPTION.
