My loan was acquired XX/XX/XXXX by Gregory Funding LLC. Even after receiving Letter of Authorization from my Bankruptcy Attorney ( XXXX XXXX ), The servicer has failed to provide me with detailed information regarding my loan- making it unclear where I stand. After excessive hold times and an escalated call back from a Bankruptcy Representative today, the servicer stated that they are unable to provide me with these two basic requests : -What months am I currently due for? ( In other words, if I make a payment today to your company OUTSIDE OF MY BANKRUPTCY AGREEMENT/POST PETITION PAYMENTS what month will my payment be applied to ) -What is the total delinquency amount? The reasons I am requesting this information are as follows : I am currently under review for mortgage payment assistance with the Virginia Mortgage Relief Program and they are in need of detailed information regarding my delinquency that I have been unable to provide due to the incompetency of my current mortgage servicer. My application has been opened since XX/XX/XXXX. My intention is also to begin making payments directly to the servicer to pay down the arrearages quicker in the event that I am denied for the XXXX however, I am disputing the total delinquency amount and would like a breakdown of payments due prior to doing so. On the call today with representative 'XXXX XXXX in the Bankruptcy Department XXXX She stammered and stuttered through the reasons she was unable to provide assistance with my requests. On the first 34 minute call ( XXXX XXXX XXXX ) I was advised that the information could not be provided to me due to the active bankruptcy ... although she acknowledged receipt of executed Authorization from my attorney. On the second outbound 37 minute call ( XXXX XXXX XXXX ) she advised the reason she could not provide the information because the Post Petition Plan was not currently in effect. She argued that the reason that they can not view or obtain the information ( months currently due ), was because the bankruptcy protects the account from Foreclosure. I advised that I am aware of the Bankruptcy Protection Act, however the mortgage servicer should still be able to provide an explanation of arrearages. She offered to send out a contractual reinstatement letter but did not seem confident that the letter would provide the information requested. I am disputing the total delinquency amount and I am requesting that all arrearages for which can not be explained be forgiven. Thank you
