I, XXXX XXXX, consumer and natural person am writing to notify you to stop all illegal and/or negative activities in association with but not limited to : my credit card, my name, and my vehicle. It has come to my attention that WELLS FARGO has violated me the consumer who is protected by federal and state law, by using my credit card without authorization illegally and producing a false promissory note with a forged signature. I WAS NEVER PRESENT AT XXXX XXXX ON XX/XX/XXXX TO SIGN THE CONTRACT THAT WELLS FARGO PROVIDED TO ME, NOR DID I GIVE CONSENT TO ENTER INTO THAT CONTRACT, AND THE SIGNATURE ON THE CONTRACT THAT WELLS FARGO SENT TO ME BY EMAIL IS AN ELECTRONICALLY FORGED SIGNATURE THAT WAS PLACED BY THE FINANCING MANAGER OR AN AGENT OF XXXX XXXX. I am disputing this alleged debt. I entered into a consumer credit transaction on XX/XX/XXXX for the purchase of a XXXX XXXX XXXX it was paid for and I owe no debt. However, on XX/XX/XXXX, WELLS FARGO violated my consumer rights by engaging in an unauthorized use of my credit card to obtain financing for a vehicle that I had already purchased when I entered into a consumer credit transaction on XX/XX/XXXX. I was not aware, nor given any notification of this transaction beforehand. 15 U.S. Code 1644 ( p ) defines The term unauthorized use, as a use of a credit card by a person other than the cardholder who does not have actual, implied, or apparent authority for such use and from which the cardholder receives no benefit. WELLS FARGO fraudulently used my credit card to produce a promissory note on XX/XX/XXXX, without authorization, which is evidenced by a statement that I received from Wells Fargo and the contract that I was sent via email of an alleged debt that is owed which is unequitable to me as a consumer. As a result, WELLS FARGO has violated 15 U.S. Code 1644 ( a ) Use, attempt or conspiracy to use card in transaction affecting interstate or foreign commerce 15 U.S. Code 1644 ( c ) Use of interstate commerce to sell or transport card. 15 U.S. Code 1644 ( f ) Furnishing of money, etc., through use of card I, XXXX XXXX, a consumer am also protected by Florida state laws which were violated by Wells Fargo XXXX. WELLS FARGO originated a loan under my name on XX/XX/XXXX without my authorization which is violation of 817.54, Fla. Stat. ( 2016 ) by obtaining a promissory note by false representation 817.645, Fla. Stat. ( 2018 ) Alteration of credit card invoice, when WELLS FARGO furnished a new contract ( please see attachment )
