I am XXXX XXXX XXXX and Im writing this complaint myself. There is no third party involved. I, a consumer, natural person and original creditor of an open-end credit plan, was denied of my right to credit by American Express National Bank on XXXX XXXX XXXX when I applied for an extension of consumer credit through my social security credit card as defined by 15 USC 1602 ( l ). I was notified of this discrimination and transgression of my rights via US mail when American Express National Bank mailed me an adverse action letter in violation of 15 USC 1691 ( a ) ( 3 ). It is AGAINST FEDERAL LAW to discriminate against any applicant with respect to any aspect of a credit transaction because the applicant has in good faith exercised any right under this chapter pursuant to 15 USC 1691 ( a ) ( 3 ). Adverse action is defined in 12 CFR 1002.2 ( c ) ( 1 ) ( i ) as [ a refusal to grant credit unless the creditor makes a counteroffer ]. American Express denied me of my right to credit without making a counteroffer and instead, discriminated against me, a consumer, in violation of the Equal Credit Opportunity Act. 12 CFR 1002.2 ( n ) defines discrimination against an applicant as treating them less favorably than others. American Express is in violation of 15 USC 1642, 15 USC 1681m and 15 USC 1691 and is liable to me and subject to enforcement pursuant to 15 USC 1691e, 15 USC 1640 ( a ) ( 2 ) ( A ) ( iii ) and 12 CFR 1002.16 for the sum of actual damages for failure to comply because I, the consumer, made an application in good faith, but credit was not issued. A hard inquiry is proof of a transaction and I have one from American Express under AMEX from XX/XX/XXXX as can be seen in the attached portion of my consumer report from XXXX, which was generated on XX/XX/XXXX. My social security number ( credit card ) was used, and I received NO benefit/equity. This and the attached copy of the adverse action letter sent to me is proof of fraudulent activity ( unauthorized use of credit card ) on behalf of American Express. If American Express fails to make any reasonable procedures to resolve this matter and compensate me for the use of my credit card I will indeed make American Express criminally and civilly liable for all actual damages through administrative enforcement and shall follow up with an invoice for {$10000.00} pursuant to 12 CFR 1002.16 ( b ) ( 1 ) and the sum of actual damages. To avoid litigation or further injury to my person I am requesting a credit card with a $ XXXX {$10000.00} limit as I look to build a good standing banking relationship with American Express National Bank XXXX have mailed American Express National Bank this notice and request to provide remedy for discriminating against me via certified mail # XXXX XXXX XXXX XXXX XXXX, with an expected delivery date of XX/XX/XXXX. As a federally protected Consumer I am demanding remedy for violation of my rights and to be granted equity for the use of my credit card in the form of a credit card from American express with a $ XXXX limit as I look to build a banking relationship in good faith. Attached to this complaint is a copy of the letter mailed to American Express National Bank, a copy of a portion of my consumer report that shows an inquiry from which I didnt benefit, as well as a copy of the adverse action letter that was mailed to me. I also included copies of my ID, my SSN card as well as a copy of my current lease in order to verify my current address since it differs from the one used during my initial application. I expect a response within 30 days of receipt and an offer that remedies the transgressions against my person and beneficiary status.
