On XX/XX/2022 I sent a request to Time Financing services regarding a derogatory tradeline being listed on my credit report. It has been over 30 days since my dispute was received, and they have yet to send me any proof validating that I owe the debt. Not only did they not respond within the legal timeframe, they also did not mark the derogatory tradeline as disputed pursuant to the FCRA. Not only are they in violation of the FCRA and the FDCPA, but they are also in violation of the North Carolina General Statute Article 70 regarding debt collections. the NORTH CAROLINA DEBT COLLECTION ACT, NC.GENERAL STATUTE.CODE 58-70-01 et seq. which prohibits a debt collector or credit bureau from engaging in debt collection in North Carolina unless the debt collector or credit bureau has obtained a surety bond and filed a copy of the bond with the Office of the Secretary of State. The NORTH CAROLINA DEBT COLLECTION ACT ( NCDCA ) defines a debt collector as any person who directly or indirectly engages in debt collection and further applies to creditors attempting to collect their own debts. NC. GENERAL.STATUTE. CODE 58.70-15 ( b ). Furthermore, NC. GENERAL.STATUTE.58-70-01 states that a person, firm, corporation or association conducting or operating a collection agency without the permit shall be guilty of a class I felony. I am writing to advise you that Time Financing Services are in violation of NORTH CAROLINA DEBT COLLECTION ACT, NC. GENERAL.STATUTE.CODE 58-70-01 et seq. as well as the DECEPTIVE TRADE PRACTICES-CONSUMER PROTECTION ACT, SUBCHAPTER E. They must immediately delete the negative tradeline from my credit report due to their violation of local and federal laws.
