Consumer Narrative

I submitted an online dispute with Experian on XXXX about the inaccurate balance on my XXXX XXXX account. I uploaded a copy of the 1099-C that I received from XXXX. I also included information with my dispute which was. The courts have found that if a financial institution has filed a Form 1099-C with the IRS, cancellation or discharge of a debt has, in fact, occurred. Therefore consumer credit reports must reflect the reporting of a {$0.00} balance. It is inequitable to require a debtor to claim cancellation-of-debt income as a component of his or her gross income and subsequently pay taxes on it while still allowing the creditor, who has reported to the IRS and the debtor that the indebtedness was cancelled or discharged, to then collect it from the debtor. Within two days Experian updated my XXXX account to the accurate balance of {$0.00}. I thought everything was fine, I reviewed my Experian credit reports on XXXX, XXXX, XXXX, XXXX and the balance on that account was {$0.00}. I have attached pages from Experian credit report with the corresponding dates. Then somehow on XXXX the balance on my XXXX account was {$22000.00}. Dumfounded by this insertion of a balance, I called Experian on XXXX and spoke with a dispute specialist. I asked her name and she said just call me XXXX, as we do not give our real names or any other identifiable information. I asked her why the balance was changed to {$22000.00}. She said that XXXX submitted the balance of {$22000.00}. I then asked how that can be when XXXX issued a 1099-C. I further stated that this must be a mistake as I had previously disputed the balance on XXXX and provided a copy of 1099-C issued by XXXX. I further explained that Experian processed my dispute and updated the balance to {$0.00} on XXXX per my dispute. I asked her to view the XXXX that I uploaded on XXXX. She said she would not, I then asked her why ; as when you send documents to Experian they become part of your file. She was rude and said you can file another dispute. I said it would be simple for her to view my dispute from XXXX and the 1099-C. She said no, so I asked to speak with a supervisor. She put me on hold for a while then came back and said no supervisors are available. I said I would wait she said no you can not wait, you are taking too much of my time, I need to take more calls I was shocked by her rudeness. I then said well you are not helping me and you will not let me speak to a supervisor so what are my options. She said I will file a dispute for you. I asked her to make sure that she attached the 1099-C to the dispute and then I asked her for a copy of the dispute as I had no idea what she said on the dispute. She said you will get an email that says a dispute was submitted. I asked again to speak with a supervisor and she said I already told you no supervisors are available. I said I would wait for one, she said no you can not do that, I will have a supervisor call you back in 1-3 hours. Well it has been days now and no supervisor called me back and the inaccurate balance is still on my Experian credit report. I am attaching a copy of the 1099-C issued by XXXXXXXX XXXX XXXX I am also attaching pages from my Experian credit report with the dates of XXXX, XXXX and XXXX for proof. Experian must follow the FCRA and update this account to the accurate balance of {$0.00} or permanently delete this account from my credit file due to the back and forth disputes. This cycle of the account balance showing {$0.00} balance then {$22000.00} then back to {$0.00} then back to {$22000.00} has to stop. I find it perplexing as to why Experian updated the balance to {$0.00} per my dispute on XXXX then sometime between XXXX and XXXX Experian changed the balance to {$22000.00}. This seems to me that Experian is not complying with the FCRA.
