I am a victim of some sort of ID attempted theft. I researched how to file a proper dispute. I followed the FCRA and the CFPB guidelines on what information is needed to file the dispute. I filed a dispute with Transunion on XX/XX/XXXX. I received a letter dated XX/XX/XXXX plus days from the receipt of my letter. The letter read that they didn't believe I was me!! Now according to the FCRA and Philbin V. Transunion , LLC, 101 F.3d957, 961 ( 3rd Cir.1996 ) A Plaintiff must prove ( 1 ) an inaccuracy ( 2 ) failure to follow reasonable procedures ; an injury and ( 4 ) the injury was caused by the inaccuracy, " A CRA responding to a dispute must make a good faith effort to determine the accuracy of the disputed item or items. In other cases, the CRA must conduct a reasonable investigation that, at a minimum, would include checking with the original sources '' This is from a FTC staff report XX/XX/XXXX page 76. I enclosed in my dispute a copy of my drivers license which has my true address, a copy of my social security card as well as a copy of the FTC file that I was advised to fill out by the FCRA and the CFPB. If the Bureaus aren't going to investigate and can simply say we dont believe you are you then what is the point of consumer protection? If Transunion can never afford me the true investigative latitude thats afforded to me by the consumer protection act what then does a consumer do? By the way I copied this information off of the internet apparently Americans are having a real problem with Transunion. Please Director XXXX make an example of them.
