Cardinal Financial failed to pay our property taxes out of our escrow account for all of XXXX. Now the county is planning to auction our house in a tax sale if the taxes plus penalties are not paid. We have never been late with a payment and there is money in our account to cover the payment yet theyve taken no action. We learned of this situation when we received a letter from our county treasurer on XX/XX/XXXX alerting us to the issue and threatening the auction of our home in a tax sale. I contacted Cardinal Financial and our county treasurer on the day the letter was received. The treasurer was able to clarify the issue. We own 2 parcels. One parcel with our house and the adjacent parcel with no structures. Cardinal paid the taxes on adjacent parcel but not on the parcel with our house. When the treasurer clarified the issue, I called Cardinal Financial immediately to alert them. I did exactly as they asked sending another email with the letter from the county along with our loan number. At this point, Ive sent 4 emails notifying them of their error, creating a paper trail by the direction of their representatives to no avail. By federal law and their own disclosures they should have responded in writing within 5 business days but we heard nothing. Its now been more than a month. We call them every day and start from scratch rehashing the situation but no one with any knowledge or authority seems to know how to facilitate a resolution. Lots of empty promises. All talk and no action. We have been told by Cardinal Financial representatives that we should have received 2 separate checks for {$1000.00} due to the overage in our escrow account resulting from their error. But we havent received these checks. Our May statement shows a disbursement for that amount that left our escrow account but it never came to us as a payment. No similar disbursement came out in XXXX when those taxes were not paid. The amount owed including penalties is now {$2700.00} for XXXX. I am fearful because the next payment is due XX/XX/XXXX. I do not think we should be held responsible for the penalties or suffer an increase in payments to cover the escrow as a result of their negligence.
