I HAVE NEW UPDATED INFORMATION! I am XXXX XXXX and I'm submitting this complaint myself and THERE IS NO THIRD PARTY INVOLVED. IF EQUIFAX NEEDS MY AUTHORIZATION TO PROCEED, THEN I GRANT EQUIFAX MY AUTHORIZATION TO PROCEED WITH THIS COMPLAINT. I, XXXX XXXX, consumer, natural person, and original creditor of an open-end credit plan, submitted a dispute of information, obtained from accounts XXXX XXXX XXXX XXXXXXXX XXXX and XXXX XXXX, to EQUIFAX and they stated that they've " verified '' that the items I disputed are being " reported correctly ''. I reached out to EQUIFAX for the details of the investigation that they did to verify this account. This is my second request and I have not received any proof of details showing that they've done an investigation. I filed my complaint about this and I requested a description of the procedures used to determine the accuracy and completeness of the information reporting. It is my belief that no such records exist and my right to privacy has been violated for profit. My financial reputation is being ruined due to EQUIFAX 's blatant disregard for federal law. It is my belief that EQUIFAX feels comfortable committing blatant violations of the FCRA because they know the CFPB will not enforce the laws set forth by congress as shown time and time again. EQUIFAX has caused me stress, anxiety, marital issues, sleepless nights, and depression due to its profits over the law mentality. Pursuant to 15 U.S.C. 1681i ( 5 ) ( A ), if any reinvestigation of any information disputed by a consumer is found to be inaccurate or incomplete or can not be verified, the consumer reporting agency shall promptly delete that item of information from the file of the consumer. Pursuant to 15 U.S.C. 1681a ( e ), " The term " investigative consumer report '' means a consumer report or portion thereof in which information on a consumer 's character, general reputation, personal characteristics, or mode of living is obtained through personal interviews with neighbors, friends, or associates of the consumer reported on or with others with whom he is acquainted or may have knowledge concerning any such items of information. However, such information shall NOT include specific FACTUAL INFOTMATION on a consumer 's credit record obtained directly from a creditor of the consumer or from a consumer reporting agency when such information was obtained directly from a creditor of the consumer or from the consumer. '' Since this statement let 's me know that their " investigation '' is not valid, this information must be excluded from my consumer report. I preferred to receive their response through the CFPB portal because I know that they've told me before that they would provide a response through the mail and it was not what I thought it would be. 15 U.S.C 1681a ( 2 ) ( A ) ( i ) also states that the consumer report should NOT include a report containing information soley as to transactions or experiences between the consumer and the person making the report. Late payments and utilizations are transactional information and experiences reporting on my consumer report from EQUIFAX.
