I have reached out to XXXX Bank multiple times now regarding a fraudulent credit card that was open in my name. I have supplied them with the FTC report and the Police Report. My identity was stolen. There were bank accounts, credit cards, and utilities open in my name. This individual was using my contact information and stole my identity. I have tried to resolve this with XXXX multiple times now and they are stating that they are unable to remove this item because they verified that it was mine. 15 USC 1681b ( c ) Furnishing reports in connection with credit or insurance transactions that are not initiated by consumer ( 3 ) Information regarding inquiries ; Except as provided in section 1681 g ( a ) ( 5 ) of this title, a consumer reporting agency shall not furnish to any person a record of inquiries in connection with a credit or insurance transaction that is not initiated by a consumer. 15 USC 1681b Permissible purpose of consumer report ( a ) IN GENERAL Subject to subsection ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) In accordance with the written instructions of the consumer to whom it relates. Pursuant 15 U.S Code 1681c-2 Block of information resulting from identity theft Except as otherwise provided in this section, a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than XXXX business days after the date of receipt by such agency of ( 1 ) appropriate proof if the identity of the consumer ; ( 2 ) a copy of an identity theft report ; ( 3 ) the identification of such information by the consumer; and ( 4 ) a statement by the consumer that the information is not information relating to any transaction by the consumer. I have supplied XXXX with all the above documents to remove this item from my credit report and close the account as fraudulent and they are refusing. I received the attached document from XXXX but no additional documents to prove that this account was mine. XXXX is stating that cards were mailed to me- I travel for work and at the time the card was opened I lived with multiple roommates XXXX is stating statements were sent to an address that belongs to me- like stated above I had roommates XXXX is stating payments were made from an account that belongs to me- there were also fraudulent bank accounts opened in my name XXXX is stating I received benefits- this is false XXXX is stating a phone # that belong to me contacted - like stated previously there were fraudulent utilities opened in my name as well. XXXX is in violation of my consumer rights and several federal laws!! I am demanding this account that arose from identity theft removed immediately from my consumer reports. The attached document from XXXX has NO EVIDENCE and NO DOCUMENTATION to prove any of these findings.
