Hi On XX/XX/XXXX I refinance my car loan, I called the company and requested the 10 day payoff. Received the check and sent to the company to payoff the car loan XX/XX/XXXX. On or about, XX/XX/XXXX. I pulled up the account and noticed an amount still due. I was told at that time my payment was postmarked and received on XX/XX/XXXX, but not posted to my account until XX/XX/XXXX, and the payoff amount was now not only past the 10 day amount, but the amount given was incorrect. I advised them at this point that I was disputing the amount as I felt it was unfair, that I was given the wrong amount and also the payment was posted late. Which if it posted on the XXXX I am not sure why that was considered late. I advised the representative until the issue was resolved I did not want any late payment submitted to the credit bureau and followed up with a letter to their presidents office. In reviewing my account they have reported the balance of XXXX as a late payment to the credit bureau. I was contacted today by one of their representatives that said they had every right to report the amount as they deemed the amount as valid. I am not sure, but I believe when there is a disputed amount they are unable to report as late until the matter was resolved and I had a chance to make payment. I asked that they send me a copy of their policy and a letter stating that once I made payment they would clear any erroneous information from my file. The representative advised I would need to submit another letter to have the information removed and they would not guarantee the removal or provide me a copy of their policy. Is this legal???
