Plaintiffs, XXXX XXXX, files the following action against Respondent ( s ) XXXX XXXX XXXX, Transunion, LLC and XXXX XXXX XXXX XXXX XXXX et al for violating 15 U.S.C. 1681 e ( b ) for intentionally and knowingly failing to assure maximum possible accuracy of information contained within consumer credit reports. FACTUAL BASIS 1. On XX/XX/XXXX XXXX XXXX requested, pursuant to FCRA 611 ( a ) ( 7 ), a description of all methods used to investigate and/or verify the accuracy of the reported information on alleged bankruptcies filed XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. 2. On XX/XX/XXXX, respondents stated to XXXX XXXX that the reported alleged bankruptcy was certified as accurate and refused to remove said information. At issue in the foregoing complaint is the failure and refusal of Respondents to remove unverifiable bankruptcy from consumer credit reports. There exists no possibility or mechanism for a Consumer Reporting Agency to verify any bankruptcy filings in accordance with 15 U.S.C. 1681e ( b ). All Federal Bankruptcy Courts are restricted from public disclosure of individuals personal identifiers by Federal Court Rule 5.2 ( a ) 1-4. Therefore, not enough information is contained with a court record for a Consumer Reporting Agency to comply with the statutory requirements of the law. In XXXX, the Respondents settled a lawsuit brought by all 50 State Attorneys in a lawsuit pertaining to the use of public records from state and local courts. As part of that settlement the Respondents created the National Consumer Assistance Plan, which in relevant part established enhanced standards ( effective XX/XX/XXXX ) requiring that state and local court public records be reported with at least a minimum of personal identifying elements to include name, address, full social security number and a complete date of birth. Because no Federal agencies intervened on the behalf of consumers, the Respondents opted to disallow Federal bankruptcies in these enhanced standards and requirements. WHERFORE, plaintiff requests that the Consumer Financial protection Bureau find Respondent ( s ) in violation of 15 U.S.C. 1681 e ( b ) and AFCRA 611 ( a ) ( 7 ) and order an immediate halt to the reporting of bankruptcy information on all related consumer credit reports. Because Respondents have been fully aware that its actions violated the rights of consumers since at least XXXX, the Plaintiffs request that the CFPB join plaintiff in federal lawsuit..
