EQUIFAX is in violation of FCRA and is civilly liable for willful noncompliance for failing to comply with a BLOCK request despite received the supporting identity theft documents. On XX/XX/2022, I submitted a BLOCK request to EQUIFAX regarding fraudulent account, XXXX XXXX, that is on my credit file. As per 15 USC 1681c-2, once a Credit Reporting Agency receives a lawful identity theft report it must BLOCK the fraudulent account within four business days, which it failed to do. Instead, EQUIFAX responded to me on the sixth day stating that my dispute results were available online. The results, posted on your portal, came in the form of a credit file, which states that the XXXX XXXX account was verified as mine. With that said, I am requesting that EQUIFAX provide me with a description of the procedure used to determine that this account is actually mine. Also, by EQUIFAX making the claim that the account has been verified as mine, are you declining to BLOCK the fraudulent account? As per 15 USC 1681c-2 to decline a block you must have reasonably determined : ( A ) a block was requested by the consumer in error ; ( B ) a block was requested by the consumer, on the basis of a material misrepresentation of fact by the consumer relevant to the request to block ; or ( C ) the consumer obtained possession of goods, services, or money as a result of the blocked transaction or transactions. EQUIFAX must provide material proof for points A through C that resulted in a reasonable determination to decline block.
