Hi, I received a line of credit number XXXX of XXXX, from XXXX XXXX on XX/XX/XXXX. Any reference stating loan is a mistake that should be line. I had asked for assistance in XX/XX/XXXX due to COVID-19 wage reduction issues. I was approved to make a payment of {$100.00} to keep my account current. I have emails that state this also. At that time, they pulled my ability to make additional drafts on the line of credit. The remaining payments would just go to the back of the loan. I was not told that this would cause additional interest to be charged for the payment assistance. I did not pay attention to this. I had a payment rejected due to an identity theft issue. That has an open case on XXXX, I provided the a copy of this. I received an email with XXXX " time limited '' offers to payoff the loan. They only sent these in an email, and did not give me offers in writing, through the mail. It was also a pressure tactic to give 15 days to accept an offer. Which if I had, this would have made me pay more interest. I was offered a payment recalculation, or a lower payoff amount with payments over 12 months from the collections department. I told them I was just letting them know that I was having issues, I asked for a payment history in XXXX format to investigate the payments I have made. They refused at first, and told me to pull all of my statements. They then emailed me a PDF, and stated they could only provide a pdf, but the PDF is made from a table, that could have been used to easily calculate the payments made. I then found out that they considered my loan in default since I made the {$100.00} payments, and was given the opportunity to put the remaining part of the payments to the back of the loan. I also found out that they have considered my account in default since that time, and additional interest was being charged for those amounts, until the end of the loan. This is against the loan agreement, and the information I was provided when they assisted me with payments due to COVID-19. This is an unsecured line of credit. So I was able to find out through the PDF that by the end of the line payments that go to XX/XX/XXXX, I will have paid $ XXXX. The line agreement states that any payments first apply to any default amounts, however, it was news to me that they were placing me in perpetual default to the end of the loan. The line agreement states interest was 44.1 %, and that this would be interest of XXXX per day. Which was a ridiculous amount, but at the time I took this out, I was under duress due to having just XXXX from a XXXX XXXX XXXX, and we were short on cash. I had planned to pay this off early, but COVID-19 hit in XXXX. So I could make an argument that I was not in the XXXX XXXX XXXX to enter into this agreement at the time. Oklahoma does not allow fees to be taken out for a draw on a line of credit. Collections stated they were not taking fees out for any draws, but seeing the interest rates, it appears they may be, and disguising them under interest. So on a {$22000.00} line of credit, I will have paid $ XXXX in interest. So a draw has a 2 year payment term on them, I made 2 additional small draws in the time of the line before they pulled the ability to draw more. So they are charging double, then triple interest for each draw, along with what seems to have a fee attached for the draw. I found out when I was inspecting my XXXX, that they were doing investigations into my home as collections. So it appears they were also going to attempt to take assets due to a default, which was an approved payment extension, with paying the {$100.00} as asked, which of course, went straight to interest. They continued to charge additional interest on the draws until the end of the loan per the payment history/amortization schedule. I would state that this is extreme predatory lending, which their parent company, XXXX, is in the business of payday and title loans as well. So, in my opinion, this company is set up to take advantage of people that are really in need of money, by charging unreasonable amounts of interest. So in looking at the amounts, they are charging more than double the amount of interest. They also breached several provisions in the contract, have a mandatory arbitration clause, and state this is an unsecured line of credit, but were going in the background with a lookup for my home with information to foreclose. Unfortunately, I'm not able to send proper copies of the emails. Headway sends them in .html format that they can change. Most of the emails have turned into html code with the message mixed in that has several items removed.
