So this case is a bit complicated but apparently I was approved for a VA CARES Act loan modification last XX/XX/XXXX but Caliber Home Loans never told me. I had promptly completed my application in about XX/XX/XXXX in response to Caliber 's written request for such documents. They apparently sent the approved modification paperwork to my then former attorney 's ( old ) office address without my consent or agreement. I had been communicating with them directly for my application so I have no idea why they did this. Because Caliber did not identify the attorney 's name or even firm name the mail was never forwarded to him and likely was returned to Caliber. I contacted Caliber by email on XX/XX/XXXX at XXXX to the same email address Caliber and I had been communicating previously ( and Caliber asked me to use ). I never received a response to my email and assumed my completed application was still in process. Later, Caliber wrote to me again at my former attorney 's ( old ) office address without my consent or agreement again in the Fall saying my modification was denied but I and my former attorney never received this correspondence either since it was sent by Caliber to the wrong address with knowledge the address was wrong. In XXXX or so I started receiving mail from Caliber 's foreclosure attorney that seemed strange and I did not understand. I contacted my former attorney who is now helping on a pro bono basis to try to figure this out. I also started the process to apply for XXXX funds from the State to see if we can make this right. But because of the problems the State had with it's role-out of the XXXX program my initial application was not accepted until XX/XX/XXXX. My attorney also told Caliber 's foreclosure counsel that my application for XXXX was pending but Caliber 's counsel has represented ( at least through today ) that it will not wait on the foreclosure anymore and Caliber claims the State has not communicated with it. The State seems to indicate that Caliber has not designated a representative until just yesterday. I first learned that a sale had been scheduled from my VA representative on XX/XX/XXXX. My pro bono attorney contacted Caliber 's foreclosure counsel who represented he had not scheduled any sale. However, a few days later he was apparently instructed by Caliber to schedule the sale even though Caliber knew I had registered with HAF. Now Caliber is advertising a foreclosure sale of my home and property even though it knows my application for XXXX is pending and I never received the modification offered to me last XXXX. I also sent Caliber a XXXX and Notice of Error about all these issues on XX/XX/XXXX which it received on XX/XX/XXXX. I have not received any acknowledgement or response whatsoever to that correspondence from Caliber.
