I am writing this complaint to inform the CFPB, Equifax and XXXX that I am a victim of identity theft. XXXX XXXX is a consumer pursuant to 12 CFR 1022.3 ( f ). Pursuant to 12 CFR 1022.3 ( g ) the term identifying information means ANY name or number that may be used, alone or in conjunction with any other information, to identify a specific person. Pursuant to 12 CFR 1022.3 ( h ) the term identity theft means a fraud committed or attempted using the identifying information of another person without authority. Equifax and XXXX is a credit reporting agency pursuant to 15 USC 1681a ( f ) and they have used my personal identifying information without consent or authority to do so. pursuant to 15 USC 1681c-2 ( a ) A consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt by such agency of ( 1 ) appropriate proof of the identity of the consumer ; ( 2 ) a copy of an identity theft report. pursuant to 15 USC 1681b ( 2 ) a consumer any consumer reporting agency may furnish a consumer report under the following circumstances and no other in accordance with the written instructions of the consumer to whom it relates. Fact, pursuant to 12 CFR 1022.3 ( i ) ( 1 ) ( ii ), identity theft report means a report that is a copy of an official, valid report filed by the consumer with a Federal, state, or local law enforcement agency. I am aware and have proof that I am a victim of identity theft. ( proof uploaded ) Equifax and XXXX is in violation of 15 USC 1681b ( 2 ). I never given Equifax and XXXX who is a credit reporting agency written instructions to furnish a consumer report on my behalf. congress mentions in 15 usc 1681 ( 2 ) and ( 3 ) that Equifax and XXXX is a CRA that assumed its roll as congress said they are and elaborate mechanism. Equifax and XXXX has no authority as must abide by federal laws and has assumed a role in containing my personal information without and using it without my consent. I hereby demand Equifax and XXXX to provide me with the documents bearing my signature with the written instructions to furnish a consumer report on my behalf. I am a victim of identity theft and my personal identifying information was used by Equifax and XXXX without authority or consent, to commit fraud and furnish a consumer report on my behalf.
