Consumer Narrative
On XX/XX/2020, I sent a correspondence letter to XXXX requesting information on a bankruptcy they were reporting to TransUnion that was inaccurate. I provided documentation from both XXXX and XXXX that this erroneous entry was deleted from my credit report along with a correspondence letter from XXXX XXXX that the bankruptcy was also deleted from my profile due to inaccuracies. I received a letter from XXXX, dated XX/XX/2020 informing me that XXXX XXXX XXXX ( XXXX ), acts as a furnisher and provided bankruptcy information to credit reporting agencies bureaus. The letter stated these records are considered " public '' even though they may contact personal information and since the information XXXX reported was obtained from a publicly available source, they do not have authority to change the information ( including opt-out preference ). The letter also stated to dispute the completeness or accuracy of this bankruptcy, I may submit a letter of dispute to XXXX identifying the specific information being disputed, the basis for the dispute, and include all supporting documentation to substantiate the basis of my dispute. I've provided all this information in my initial dispute and they failed to overlook it. TransUnion collects date from XXXX XXXX and XXXX for public records. XXXX XXXX is regulated under the FCRA but XXXX is not when they report the same information, why? Can you explain the difference between the two types or data collections? That BOTH affect credit worthiness? Section 603 ( d ) ( 1 ) defines " consumer report '' as communication by a reporting agency with information that bears in a consumers credit worthiness ( see attached image for full definition ). How is XXXX not being regulated by the FCRA then? XXXX 's website stats to contact TransUnion in the event a consumer suspects their bankruptcy information is erroneous. However, TransUnion 's website directs us to contact XXXX if we have questions on the bankruptcy. Why is there a conflict of information? Who exactly should the consumer contact? Secondly, on XXXX 's website, they EXPLICITLY state " XXXX DOES NOT MATCH XXXX INFO TO TRANSUNION CREDIT FILES '' ... ..So, how does TransUnion consider this information verified if XXXX is stating they do not verify such information? Also, why is PrivacyRights.org reporting XXXX to have claimed to be covered by the Fair Credit Reporting Act ( FCRA ) if they are not ( see attached image for documentation purposes )? FCRA Section 603 ( 5 ) ( p ) also recognizes any company who supplies public record information to TransUnion ( or any credit reporting agencies ) as a " consumer reporting agency '' Again, how can XXXX report anything to TransUnion on a consumer if they are being recognized as a reporting agency?
