XX/XX/2021 I was served with a lawsuit filed by SECOND ROUND SUB LLC. I was blindedsided, first I had never heard of second round sub LLC or their allegations. I was sent nothing from Second round sub LLC or the law firm they are using to bypass the laws regarding debt collector lisensing. Nothing was sent to me prior to the lawsuit papers. Nothing sent by second round sub LLC or their hired law firm XXXX XXXX XXXX. I confirmed SECOND ROUND SUB LLC, IS NOT LISENSED TO collect or obtain a debt for collection on a Arkansas resident. I have found mixed interpretations on this Arkansas law, it looks like there is a grey area, these type third party debt collection agencies are abusing that grey area to file lawsuits on thousands of unexpecting Arkansas residents. Most of these civil cases end in a default judgement and the debt buyer then legally robs the individual for whatever amount they have made up and stuck in a baseless lawsuit. It's awful! it's criminal and must get regulated. Something has to be done. Look at the Arkansas civil court dockets. It's overwhelming packed with lawsuits as I just described. Consumers need to understand just because a third party debt collector says something in a lawsuit DOES NOT MAKE IT FACT. Not by a long shot. In my case, I absolutely deny what they are aledging, I know there is no factual evidence, because the allegations never happened. This has to stop. When a company is using a law firm to come after unexpecting individuals, they are using the courts as a weapon and it's threatening and can be very intimidating to a individual. Third party " junk debt buyers '' entire business model is based on default judgements! Where is the justice in this! It's twisted into legal robbery! Throwing hundreds of thousands of individuals and their families into bankruptcy, homelessness, a wide variety of negative impacts by this " grey area " and these business models set up to abuse it. I am filing a complaint on second round sub LLC with you and the with the Arkansas debt collector lisensing agency.
