I originally received a warning which stated Gurstel Law Firm was going to be garnishing my wages on XX/XX/XXXX. I promptly reached out to them to confirm the debt was mine as I did not recognize the debt. I was attempting to purchase a home at the time so I was very aware of my credit score and any debt owed. While calling I was transferred to the attorney, XXXX XXXX. Through confirming my SSN and date of birth we had come to the conclusion that it was not my debt owed and it was my father 's debt. My father and I, unfortunately, have the same name with the exception of XXXX and XXXX. I was told by XXXX that he would make note of it and all was cleared and notice was sent to not garnish wages. XX/XX/XXXX, I received a letter dated XX/XX/XXXX stating that Gurstel Law Firm would be garnishing my wages once again, for the same debt with the same file number. Clearly, XXXX did not make a note in the file. I immediately reached out to XXXX to resolve the issue. He was not available. XX/XX/XXXX I was able to get in contact with XXXX again and he was not as pleasant. Through once again confirming my SSN and date of birth we found it was not my debt, once again. This time I asked what he was going to do to ensure I did not keep facing penalties of my father 's debt, to which he was unable to offer any definitive answer. I then informed him of how this is considered fraud, and in direct violation of the FDCPA to which he responded " I don't need to take legal advice from you. '' While, no, I am not licensed to practice law. I clearly have a better understanding of it than some of the attornies at the aforementioned collection agency.
