This complaint is principally made in order to provide additional documents to the matter of CFPB complaint XXXX regarding Capital One 's charging of late fees on a closed account. The attachment includes all statements from XXXX through XXXX, showing the additional late charges and interest charged on a CLOSED account. It appears Capital One stopped charging late fees after I complained to the CFPB. In a phone call today, XX/XX/2022, I called the PRIVACY phone number ( XXXX ) XXXX to opt out of personal information sharing to affiliates regarding my creditworthiness and affiliates and nonaffiliates to market to me. That number had a recording that the purpose of the call was collection of a debt. The representative identified herself as a general customer service agent. As I told her, I called the direct privacy phone number, not the general toll-free customer service phone number, ( XXXX ) XXXX. She said she needed to forward me to the privacy representative. That representative would not accept my election even after I identified the three types of information I am allowed pursuant to federal law to opt out. He said he needed to transfer me to a supervisor. This conduct is not consistent with the regulations regarding privacy opt out. It is required not to be on the general toll free number and has nothing to do with debt collection. The account is closed. Capital One, if it insists may take me to court based on the balance at the time of account closure. I simply want to opt out of Capital One sharing my personal information as allowed by federal law.
