Around XX/XX/21 I put in a web request for refinancing with a $ XXXX cash out on a property in XXXX XXXX Texas. The first company to reply was LoanDepot and I started their process. The intake person I spoke on the phone was XXXX XXXX, Licensed Lending Officer NMLS # : XXXX. He quoted me the rate for investment homes at 3.625 % and no problem on the cash out. I filled out their electronic forms, they provided me with a conditional approval letter ( loan XXXX ) and collected {$21.00} fee to run my credit report ( low XXXX or near perfect ), they asked for a lot of information, I locked the rate early, and they asked for {$21.00} and {$490.00} to run my credit and pay for appraisal. I did. Fast forward 2 months later, the refinancing isn't closing. I ask repeatedly, what's going on, why are they having trouble closing? Their senior loan specialist XXXX XXXX stopped answering emails to me. I started calling the intake person XXXX XXXX and almost simultaneously I get a denial letter ( they had approved me conditionally twice ; I have the letters ) saying they were denying the loan because they were " unable to verify residence ''. However, XXXX XXXX over the phone tells me that cash out on rentals are not allowed because I live in CA. My guess is that he knew this from the beginning and took my {$21.00} and {$490.00} fees knowing I wasn't going to get approved. I, as a consumer didn't know that, but since, I have verified that information with other lenders. Additionally, the loan rates have gone up causing me to lose the window of opportunity to get a better rate. Deceptive practice or incompetent ( two senior ) staff? I want at the least my money back. I received a letter 2 weeks ago saying that a representative was going to call to try to remedy my complain... No one has called. I'm not holding my breath on that one.
