My mother, XXXX XXXX XXXX, passed away on XX/XX/XXXX. She had been in a XXXX XXXX & my sister had been her Legal Guardian of the Person & the Estate. Her job stopped the moment my mother passed away. My mother had a will & I am the XXXX. My job started the moment my mother died. I went to the XXXX XXXX XXXX XXXX XXXX XXXX on XX/XX/XXXX to record her death & start the administration of her estate. They were behind in their work & didnt have the Short Certificates available then. They mailed them to me. I got them in the mail on XX/XX/XXXX. I made an appointment at XXXX XXXX XXXXXXXX, PA for XX/XX/XXXX, to set up an Estate Bank Account. I then made an appointment at Wells Fargo Bank for XX/XX/XXXX. I showed XXXX XXXX my ORIGINAL DEATH CERTIFICATE & SHORT CERTIFICATE. She noted that & made copies of both. She then called her contact at some legal division of the bank. They told her there was a hold put on the account & that only they can lift it. They also told her that ONLY my sister can close the account. I told them that was against the law. The law states that Legal Guardianship ends upon death. XXXX stated that to whomever she was on the phone with, but they would not budge. She said she has to follow their rules. I had checked with my friend who is a lawyer prior to going to Wells Fargo. He told me what the law was. While I was at Wells Fargo, I called XXXX XXXX from XXXX XXXX ( the woman who set up my mothers Estate Checking ). I put her on speaker phone. She explained exactly what I had said to XXXX. XXXX got up & stormed out of the office & came back with the bank manager. She said the same thing. They have rules & they must follow Wells Fargo procedure. They did finally issue a Cashier 's Check made out to XXXX XXXX XXXX XXXX for {$12000.00}, which was the amount in my mother 's Irrevocable Burial Fund, which left a balance of {$1300.00}. I did forward that check to them. There is also an outstanding balance of {$2200.00} owed to XXXX XXXX, as well as another {$3000.00} for the headstone owed to XXXX XXXX XXXXXXXX XXXX XXXX XXXX ( thru XXXX XXXX ). As well as ap proximately {$2000.00} ( so far ) owed to me for expenses paid by me. By law, they have to release that money in a Cashier 's Check made out to the Estate of XXXX XXXX XXXX, which I will then deposit into my mother 's Estate Checking Account I set up at XXXX XXXX
