I, XXXX XXXX, entered a consumer credit transaction with XXXX on XX/XX/XXXX. XXXX has failed to disclose the right of rescission which is a violation pursuant to 15 usc 1635. Because they willfully and knowingly withheld this information XXXX is criminally and civilly liable and owe me twice the finance charge pursuant to 15 usc 1611 and 15 usc 1611. Pursuant to 15 usc 1605 is finance charge which is the sum of all charges in a consumer credit transaction. The finance charge is supposed to include insurance they made me purchase my own. XXXX has threatened to reposes my vehicle which is a violation of 15 usc 1692e ( 4 ) due to non payment and they have never validated the debt pursuant to 15 usc 1692g. I did send a debt validation letter to them on XX/XX/XXXX. Also on this day I mailed a cease and desist letter 15 usc 1692c, also I mailed and had notarized an affidavit of truth which was unrebutted. I still have been receiving calls and emails stating this is an attempt to collect a debt which is a violation pursuant to 15 usc 1692b ( 2 ) and 15 usc 1692c. Other ways XXXX has violated me are by harming my reputation by reporting negatively to the credit bureaus pursuant to 15 usc 1692d ( 1 ), by providing me with false and misleading information by showing balances in a positive amount 15 usc 1692e, by using symbols on envelopes mailed to me 15 usc 1692f ( 8 ), and in the contents of the envelope 15 usc 1692b ( 5 ), threatened and used obscene language 15 usc 1692d ( 2 ), and threatened to action that they can not legally take 15 usc 1692e ( 5 ). Pursuant to 15 usc 1692k I mailed an invoice for every violation on XX/XX/XXXX. I allowed XXXX days to respond and pay and they did not. On XX/XX/XXXX I mailed out a default and opportunity to cure, a new invoice with new charges and gave them XXXX days to either settle or send me payment amount listed on the invoice or I will seek litigation for non payment of violations. XXXX stated they are not a debt collector. Pursuant to 15 usc 1692a ( 6 ) the term debt collector means any person who uses the mails in any business for the principal purpose of which is the collection of any debts, or who regularly collects or attempts to collect, directly or indirectly, debts owed or due or asserted to be owed or due another.
