I am XXXX XXXX and I'm submitting this complaint myself and there is no third party involved. Due to Transunion being a Consumer Reporting Agency and collecting fees for reporting information on consumers, they are not exercising their grave responsibilities with fairness, impartiality, and respect for the consumer 's right to privacy. Transunion received everything required under the FCRA needed to remove and place a block on the information that resulted from identity theft as proof through CFPB Complaint number XXXX and XXXX submitted on XX/XX/2021. It is now XX/XX/2021 and Transunion has yet to place a block on all information resulting from identity theft. I called Transunion today at XXXX pm and requested information on the block of information resulting from identity theft. A representative of Transunion informed me that they were not placing a block on the information because of the company policy they have in place. I informed the representative that their companies policy does not supersede Federal law and according to Federal Law, I submitted everything that was required. 15 USC 1681c-2 states that a Consumer Reporting Agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from identity theft, no later than 4 BUSINESS DAYS after the receipt of the following : 1. Appropriate proof of identity of the consumer ; 2. A copy of an Identity theft report ; 3. The identification of such information by the consumer ; and 4. A Statement by the consumer that the information is not information relating to any transaction by the consumer. I have not received any sworn statements from any senior Executive member of this company on an affidavit signed under the penalty of perjury. Therefore, Transunion is willingly and knowingly violating my federally protected rights under the FCRA to protect a business relationship they have with these organizations by allowing them to park debt on my consumer report in order to ruin my financial reputation. 15 USC 1681 ( b ) states that consumer reporting agencies must adopt reasonable procedures for meeting the needs of commerce for consumer credit in a manner that is fair and equitable to the consumer, with regard to confidentiality, accuracy, relevancy, and proper utilization of such information. If Transunion allows its policies and business partnerships with these organizations to continue to violate my FEDERALLY PROTECTED CONSUMER RIGHTS, they will be liable to me for the stress, XXXX, sleeplessness, and any other actual damages caused as a result of the failure as allowed under 15 USC 1681n and 15 USC 1681o.
