I hate making a complaint against a business, but I just don't understand why I'm being sued after making payments for the past XXXX months. I was served a summons and complaint on XX/XX/2021 that has an old date of XX/XX/2021 on both the summons and the complaint. It was sent via certified mail by XXXX XXXX, XXXX based out of XXXX Prior to receiving this summons XXXX setup a written payment plan and have made consistent, timely payments for the last XXXX months. Payments are due at the end of every month. On XX/XX/2021 Johnson Mark sent me a debt collection letter regarding a XXXX XXXX debt that I could not afford to pay during the pandemic. In the second paragraph of Johnson Mark 's letter it states To resolve this matter, you may either pay the Total Amount Due ( unless it has already been paid ) or contact the law firm at XXXX and work out arrangements for payment. If you do neither of these things, our client may be entitled to file a lawsuit against you or take further action for the collection of this debt. On XX/XX/2021 I responded to Johnson Mark 's letter. My letter was delivered on XX/XX/2021, signed for by XXXX XXXX, XXXX tracking # XXXX. In my letter I requested that the debt be verified. I thoroughly explained why I was making that particular request, explained the loss of both of my brothers and the affects of the pandemic. I also ask if XXXX XXXX was willing to accept a lesser amount and if I could get a copy of my credit card agreement. On XX/XX/2021 Johnson Mark sent me a verification of debt letter that contained copies of credit card statements. I had also asked for a copy of my credit card agreement. I had requested in my letter that I be allowed 30 days to review their information, but that request was not fulfilled for some reason. On XX/XX/2021 I responded to Johnson Mark 's XX/XX/2021 letter. My letter was delivered on XX/XX/2021, signed for by XXXX XXXX, XXXX tracking # XXXX. Since Johnson Mark was not able to give me XXXX days to review their debt verification letter, I was worried about a lawsuit and set up a written payment plan in this letter I wrote. This is due to the fact that they stated I could avoid a lawsuit if I made arrangements for payment. I set up my own written payment plan that is listed in my XX/XX/2021 letter. My first payment was delivered XX/XX/2021. All seemed to be going well until I was served on XX/XX/2021. Once again the summons and complaint have a date of XX/XX/2021 listed on them. Here are my payments, they have been confirmed as received via tracking numbers. All tracking numbers can be provided upon request. Payment # 1, due XX/XX/2021, delivered on XX/XX/2021. Payment # 2, due XX/XX/2021, delivered on XX/XX/2021. Payment # 3, due XX/XX/2021, delivered on XX/XX/2021. Payment # 4, due XX/XX/2021, delivered on XX/XX/2021. Payment # 5, due XX/XX/2021, delivered on XX/XX/2021. Payment # 6, due XX/XX/2021, delivered XX/XX/2021.
