I consumer XXXX XXXX is not obligated to pay any debt under the provisions of XXXX XXXX XXXX ( 3 ). CAPITAL ONE has violated my federally protected consumer rights. CAPITAL ONE has reported my personal non public information to the consumer reporting agencies of debt that I don't owe. This is a violation of XXXX XXXX XXXX XXXX XXXX XXXX XXXX The consumer must have an option to OPT out of credit reporting before such information is reported, CAPITAL ONE did not give disclosure of documents to opt out of reporting. According to the CFPB 's handbook XXXX XXXX Incentives and Disincentives. Reporting to credit bureaus and other consumer reporting agencies by CAPITAL ONE is voluntary and CAPITAL ONE has taken advantage of my federally protected consumer rights. I've sent a Cease and Desist several times and CAPITAL ONE believes the only form of communication is by telephone. CAPITAL ONE admits to follow the cease and desist but refuses to follow federal law of XXXX XXXX XXXX ( c ) - cease all communications except to inform the consumer that they will cease collection activities. Pursuant to XXXX XXXX XXXX ( 2 ) the term " communication '' means the conveying of information regarding a debt directly and indirectly to any person through any medium. This means that CAPITAL ONE can not send ANY communication regarding debt in any way in which makes CAPITAL ONE in direct violation of a cease and desist in place that was sent and received. It was demanded of CAPITAL ONE to validate alleged debt under the provisions of XXXX XXXX 1692g and CAPITAL ONE has failed to due so or respond to several Affidavits of Truth line by line.
