I am XXXX XXXX, and I am submitting this complaint myself and there is no third party involved. I, XXXX XXXX, consumer, natural person, and original creditor of an open-end credit plan as defined by 15 USC 1602, am disputing the alleged debt with TEXAS HIGHER EDUCATION COORDINATING BOARD and furthermore they have violated my rights as a consumer. I can not be liable to the debt in question as I used my credit card, as defined by 15 USC 1602, to obtain money to attend the XXXX XXXX XXXX XXXX XXXX. For the TEXAS HIGHER EDUCATION COORDINATING BOARD to state that I owe them any money is in violation of 15 USC 1692e ( 2 ) ( A ). In addition to their false and misleading representations they communicated with the ATTORNEY GENERAL OF TEXAS which is a violation of 15 USC 1692c ( b ) and 15 USC 1692e ( 3 ). In this communication it stated that I was delinquent in the repayment of said debt and threatened me with suit, which is a violation of 15 USC 1692e ( 1 ) and 15 USC 1692e ( 5 ). Said communication is also in violation of 15 USC 1692d ( 1 ) and 15 USC 1692d ( 2 ) as they illegally threatened me with suit and used abusive language. In the very same communication, they stated that an amount is due which is a violation of 15 USC 1692j ( a ). Furthermore, TEXAS HIGHER EDUCATION COORDINATING BOARD communicated with XXXX and had information furnished on my credit file without my written consent in violation of 15 USC 1681b ( 2 ). Pursuant to 15 USC 1692h, if any consumer owes multiple debts and makes any single payment to any debt collector with respect to such debts, such debt collector may not apply such payment to any debt which is disputed by the consumer and, where applicable, shall apply such payment in accordance with the consumers directions. I am directing TEXAS HIGHER EDUCATION COORDINATING BOARD apply the seven single payments, totaling {$1400.00}, to myself by check.
