This has been an ongoing dispute with Capital One bank since XX/XX/XXXX. After noticing a {$3500.00} withdrawal from my account and notifying Capital One of this fraudulent transaction, I received a letter dated XX/XX/XXXX stating that this was a valid transaction and that my claim was being denied. ( I closed the account on XX/XX/XXXX. ) The letter also gave a number to call to " request any documentation we used to make this decision ''. After numerous attempts to get through on this number and 45 minutes on hold finally got to speak to a person. My request at this time was to be sent all documents used to determine their decision which " denied the claim of fraud ''. After 23 minutes on the phone and supplying all requested information i.e. account number, personal info and claim number was told this information would be mailed to my home address. After one month had passed and I still had not received requested documents I enlisted the help of my niece who was able to find an e-mail address for complaints and sent another request for documents through this Capital One complaints email address. Finally received by mail another " denial of claim '' letter dated XXXX XXXX which included a list of transactions from someone's bank account showing how my money was moved into their account. However, it did not include the most important information which should be the only reason to deny my claim and that is the " signed authorization '' indicating that I gave permission for someone else to use my account. This obviously does not exist. After numerous other calls, emails and faxed correspondence I was sent an affidavit to sign stating that I never gave anyone permission to access my account. Signed and faxed this form the same day and called to confirm and was told that it was in fact received. It has been three weeks since I sent this document and I still have not had a response. All information, including account statements, previously sent and received correspondence, etc can be provided on request. Please note that I am a XXXX XXXX XXXX man in poor health and do not need this ongoing stress. I am hoping you can assist in getting my money back from Capital One bank. Also of note I made many personal visits to numerous Capital One branches over these past few months and was unable to get help from anyone. Thank you in advance for your assistance.
