Consumer Narrative
Hello, and I want to first thank you for correcting all the fraudulent activity occurring in our day to day lives. I went to a dealership back in XXXX of 2021 to a XXXX XXXX located at XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, Virginia XXXX and was seeking a used car I was interested in. The actual finance manager, XXXX XXXX actually stated that the 'Bank ' wouldn't want me in a particular car, they still kept my application which I'm sure they've sold my security as well as my identity, and also she showed great discriminations, despite stating that she follows all FDCPA, TILA, FTC AND FCRA rules and regulations. I was instructed to have my brother also send in his information, and he too was made to fill out an application, as well as submit his banking info. All that just to still be denied, and they sold the car to another gentleman who happen to arrive after I test drove the vehicle. I realized upon research that the " dealership '' are actual XXXX, dealing in assignment of contracts ( commercial paper ), once you give them ssn they just became the XXXX Insult to injury the securitize the accounts receivable ( installment loan payments ) which in fact is our accounts receivable on the extension of credit we made to them. Correct! I realized you, meaning I, are the lender and they are the borrower! Any promissory I sign puts you as the nominee and gives them power of attorney for the transaction. However, we are all a party to the transaction. Heres why : XXXX XXXX ( c ) issue of instrument : means maker or drawer of an instrument XXXX XXXXXXXX Definition ( 7 ) Maker- the person who signs or identified in a note as the person undertaking to pay. Article XXXX Adverse claim. XXXX XXXX ( a ) ( 1 ) " Adverse claim '' means a claim that a claimant has a property interest in a financial asset and that it is a violation of the rights of the claimant for another person to hold, transfer, or deal with the financial asset. Financial asset means security. You have a property interest in the sale of the security since they are making you a party to an investment contract. XXXX XXXX ( 9 ) financial asset is a security XXXX XXXX XXXX to an instrument- a person taking an instrument, other than a Holder in due course is subject to a claim of a property or possessionary right in the instrument or its proceeds. **A person having rights of a Holder in due course takes free of the claims of the instrument. I have studied Accounting for quite some time, and have come to realize some things. An accounts receivable that is non-current is considered an intangible-asset and can be amortized. Another thing, it is standard practice for uncollected accounts receivable ( Debts ) to be written-off the Balance sheet as an expense after XXXX years. XXXXI always wondered why Drivers Charges got purged after XXXX years, and many other things, their deception compels the presumption of blank indorsement i.e. incomplete instrument, gift, abandonment, etc and they're implying a creditor debtor relationship to compel our breach of trust to establish a controversy... we have to express the trust by demanding their performance on their liability. Can you please assist me in this matter, its definitely has been a big disruption in my life. I request that I be compensated for the disrespect, the emotional distress, as well as a plethora of other violations these persons have intentionally and willfully committed. I thank you in advance.
