Consumer Narrative
I've informed TransUnion via the CFPB on XX/XX/XXXX and via the USPS certified mail on XX/XX/XXXX that I have become a victim of identity theft. There are accounts on my report which do not belong to me. These accounts are hindering me from obtaining new credit and thus causing me much hardship and discouragement. I sent a dispute notice with supporting documentation, i.e ; FTC Report, Police report, etc., yet the fraudulent accounts remain on my consumer report. I have received a USPS return receipt signed by TransUnion LLC on XX/XX/XXXX, which is proof that TransUnion has received my dispute and that I do Not agree with the response from TransUnion via the CFPB. The fraudulent accounts on my consumer report are inaccurate and have not been validated, pursuant to 15 USC 1692g Sec. 809 ( b ) of the FDCPA or removed pursuant to FCRA 605B ( 15 U.S.C. & 1681 c-2 ). Each time and most recently on XX/XX/XXXX TransUnion has responded by stating that an investigation with the furnisher of the information has been initiated and when the furnishing company provides their findings, they will send those results to me. As of XX/XX/XXXX TransUnion has not provided me with those results nor procedurally proper validation of the debt ( s ). A copy of the consumer credit contract and/or bill is not sufficient to validate the debt. Validation requires presentment of the account and general ledger statement signed and dated by the party responsible for maintaining the account . Pacific Concrete F.C.U. v. E.2d 1045 ( 3Dist. 1987 ). Pursuant to 12 CFR Part 1022 Subpart M 1022.120 1022.129, TransUnion is in violation by not responding to my notice of Identity theft within 30 days.
