In the Code of Federal Regulations Under XXXX Billing errorresolution under C2 it statesC2 - The Creditor shall comply with the appropriate resolution procedures of paragraphs ( e ) and ( f ) of this section, as applicable, within 2 complete billing cycles ( but in no event later than 90 days ) after receiving a billing error notice.I openeda disputeagainstXXXX that was billed on XXXX XXXX in the amount of {$2000.00} on XX/XX/XXXX, I was credied the {$2000.00} on XX/XX/XXXX. I didn't hear from Capital One about this dispute and was rebilled on XXXX XXXX XXXX - XX/XX/XXXX is 106 days which is past the allowed 90 days by law. I didn't receivethe paperwork that Capital One states they sent out. This is not the first time I haven't receiveddisputed paperwork. OnXXXX I receivedpaperwork from Capital One with conflicting info.Case numberon this page was XXXX, they state I opened the case on XX/XX/XXXX. This was a different case and they are mixing cases, see below..XXXX XXXX, XXXX I opened a disputeagainst XXXX for a purchase on XXXX in the amount of {$2000.00} I sent in paperwork and it was rebilled on May 11thMay 11, XXXX I opened up a different dispute against XXXX in the amount of {$2000.00} for the purchase on XX/XX/XXXX this was rebilled on XX/XX/XXXX, XXXX.They have the same case numbers on both disputes which are two different disputes.I have a picture of each dispute side by side and you can see it has the same case number XXXXOn XX/XX/XXXX I received a letter saying they receivedmy response which is a lie. I never sent anything in because I never received any paperwork for the {$2000.00} dispute.Capital One has done 3 things wrong and I would like a response to each 1. They are combiningtwo different cases2. I did not receiveMay XXXX letter of instructions to send in paperwork.3. It took 106 days to end the case which is more than the 90 days allowed. ( Capital One has never given an answer to why they took longer than 90 days ) My lawyers have reached out, Capital One sent me a letter with another Capital One different case number XXXX. I tried to give consentbut the rep didn't know what I was talking about and how to put it into the system. Under the Federal Trade Commission under Disputing Credit Card Charges it statesComplaints -You also can sue a creditor who violates the FCBA. If you win, you may be awarded damages, plus twice the amount of any finance charge as long as it's between {$500.00} and {$5000.00}, or higher amounts if a pattern or practice of violations is established. The court also may order the creditor to pay your attorney 's fees and costs. Capital One can contact me directly or through the CFPB. If this can not get settled then I will be taking Capital One to court for breaking the law. The law is attached.
