Violations 1. Down Payment +Pursuant to 15 USC 1605 ( a ) Thefinance chargedoes not include charges of a type payable in a comparable CASH transaction. A down payment was advertised in order to extend credit. 2. Unlawful Repossession 1. Extension Posted XX/XX/XXXX 2. Payment made on XX/XX/XXXX in the amount of {$270.00} REF : XXXX XXXX. Repossession Expenses {$420.00} incurred on XX/XX/XXXX. 4. Repossession occurred after payment which means account not in default 5. I spoke with a rep who admitted she wasn't sure why it happened if I made a payment but, didn't fix the problem and refused to help me resolve the issue. 3. Violations During Repossession 1. Breach of Peace incurred. Vehicle repossession from Private & GATED community. There is no PUBLIC access where the repossession occurred. Repossession company was not granted access to the secured area. 2. Violation in pursuant with Universal Commercial Code that secured lenders also breach the peace if they : ( 1 ) repossess the collateral despite the consumers objections ; or ( 2 ) TRESPASS in order to gain possession of the collateral. 4. Repossession Expenses 3. On XX/XX/XXXX Payment was made in the amount of {$2000.00} ( REF XXXX ). I instructed rep to apply it to repossession expenses. Rep did not apply it to expenses and instead towards monthly payments. + In Pursuant to 15 USC 1692 ( h ) shall apply such payment in accordance with theconsumers directions. 5. I've also asked on many occasions to produce the paperwork however, representatives frequently transfer me to incorrect departments and refuse to provide me with information that I have a right to receive.
